Foam Party Explosion

Liability Waiver & Release of Claims

By signing this Waiver, the undersigned (“Client”) acknowledges and agrees to the following:

1. Voluntary Participation & Assumption of Risk

  • Participation in foam party activities is voluntary.

  • The Client understands that foam party activities involve inherent risks, including but not limited to:

    • Slips, trips, and falls

    • Collisions with participants or equipment

    • Eye irritation, skin irritation, allergic reactions

    • Breathing discomfort or coughing

    • Minor or serious injury

  • The Client knowingly and freely assumes all risks, whether known or unknown, foreseeable or unforeseeable.

2. Release of Liability

  • The Client releases, waives, and forever discharges Foam Party Explosion, its owners, employees, contractors, agents, and representatives from any and all claims, demands, actions, causes of action, or liabilities of any kind.

  • This release applies to personal injury, illness, medical conditions, disability, death, property damage, or financial loss arising from participation.

  • This release applies before, during, and after the event.

3. Medical Acknowledgement

  • The Client confirms that all participants are physically able to participate.

  • The Client understands that foam may cause irritation to individuals with:

    • Asthma or respiratory conditions

    • Allergies or sensitive skin

    • Mobility or balance limitations

  • Foam Party Explosion is not responsible for any medical issues, reactions, or injuries resulting from participation.

  • The Client assumes full responsibility for seeking medical attention if required.

4. Responsibility for Minors

  • The Client is the parent or legal guardian of all participating minors or has permission to sign on their behalf.

  • The Client accepts full responsibility for the supervision, conduct, and safety of all minors.

  • Foam Party Explosion does not provide childcare or supervision.

  • The Client agrees that this Waiver applies equally to all minors under their care.

5. Property Damage Disclaimer

  • The Client understands that foam and water use may cause:

    • Wet or slippery surfaces

    • Damage to lawns, grass, landscaping, decks, driveways, or flooring

  • Foam Party Explosion is not responsible for any property damage, moisture damage, residue, or clean-up.

  • The Client accepts full responsibility for hosting the event on their property or rented location.

6. Equipment Use & Damage

  • All equipment remains the property of Foam Party Explosion.

  • The Client agrees not to operate, move, or interfere with equipment unless authorized.

  • The Client is financially responsible for any loss, theft, or damage to equipment caused by guests or participants (excluding normal wear and tear).

  • In unstaffed rentals, the Client assumes full responsibility for safe operation and care of equipment.

7. Indemnification

  • The Client agrees to indemnify and hold harmless Foam Party Explosion from any claims, lawsuits, damages, legal fees, or expenses arising from:

    • Participant injury

    • Property damage

    • Violation of rules or instructions

    • Actions of guests or minors

8. Compliance with Instructions

  • All participants must follow all safety instructions provided by Foam Party Explosion staff.

  • Foam Party Explosion reserves the right to remove any participant acting unsafely or inappropriately without refund.

  • Failure to follow instructions voids any claim against Foam Party Explosion.

9. No Insurance Coverage

  • The Client understands that Foam Party Explosion does not provide medical insurance for participants.

  • Any injuries or medical expenses are the sole responsibility of the Client or participant.

10. Photography & Media Consent

  • The Client grants permission for photos or videos taken during the event to be used for promotional purposes.

  • The Client may opt out by providing written notice prior to the event.

11. Governing Law

  • This Waiver shall be governed by and interpreted in accordance with the laws of the Province of Manitoba, Canada.

12. Acknowledgement & Signature

  • The Client confirms they have read and understood this Waiver in full.

  • The Client understands that by signing this Waiver, they are giving up certain legal rights, including the right to sue.

  • This Waiver is binding on the Client, participants, heirs, and legal representatives.
