1. Booking & Payment Terms

• All events must be booked in advance.

• A non-refundable deposit of $100 is required to secure your event date.

• Your booking is not confirmed until the deposit has been received.

• Dates will not be held without a deposit.

• The remaining balance is due no later than three (3) days prior to the scheduled event date.

• Full payment must be received by this deadline in order for the event to proceed as scheduled.

Accepted Payment Methods:

• E-transfer

• Credit card

• Cash

• If the remaining balance is not received by the due date, we reserve the right to cancel the event without refund of the deposit.

• Late payments may be subject to additional fees.

2. Cancellation and Refunds

• We understand that plans can change, and we will do our best to accommodate adjustments whenever possible.

• Cancellations made at least three (3) days prior to the scheduled event date are eligible for a refund of all payments made, excluding the non-refundable deposit.

• Cancellations made less than three (3) days before the scheduled event may result in forfeiture of all payments made.

• If the client is not present at the scheduled event time and location, the booking will be considered a no-show, and all payments made will be non-refundable.

If Foam Party Explosion must cancel or reschedule due to severe weather, safety concerns, equipment malfunction, or other unforeseen circumstances, clients will be offered the option to:

• Reschedule the event to a mutually agreed-upon date, subject to availability; or

• Receive a full refund, including the deposit.

3. Safety and Conduct

• All participants must follow instructions provided by Foam Party Explosion staff at all times.

• Children must be supervised by a responsible adult throughout the duration of the event.

• Participants must remain within designated foam areas.

• Running, roughhousing, or other unsafe behavior is strictly prohibited.

• Participants should remove jewelry, glasses, and any sharp objects before entering the foam area.

• Individuals with medical conditions (including but not limited to respiratory issues, skin sensitivities, or mobility concerns) should consult a physician before participating.

• In case of emergency, all participants must immediately follow staff instructions.

• Foam Party Explosion reserves the right to remove any participant behaving in an unsafe, disruptive, or inappropriate manner without refund.

Swimming Pool Prohibition

• Foam use in or around swimming pools is strictly prohibited.

• Foam must not be directed into a pool, and participants may not enter a swimming pool while foam is present.

• Violation of this policy may result in immediate termination of the event without refund.

4. Equipment and Venue Requirements

To ensure a safe and successful event, the Client agrees to provide:

• Adequate open space suitable for foam activities.

• Access to a standard three-prong electrical outlet within fifty (50) feet of the event area.

• Access to a working water source with a hose spigot within fifty (50) feet of the event area.

• A clear event area free of obstacles, sharp objects, pet waste, toys, furniture, and debris prior to Foam Party Explosion’s arrival and setup.

• An event surface that is reasonably level and suitable for foam activities.

• Foam Party Explosion reserves the right to refuse setup or discontinue operation if site conditions are deemed unsafe, hazardous, or otherwise unsuitable.

5. Equipment Use & Rental Agreement

• All foam machines, generators, extension cords, hoses, and related equipment (“Equipment”) remain the sole property of Foam Party Explosion at all times.

Staffed Events

• Only authorized staff may operate, move, adjust, or handle the Equipment.

• Clients and guests must not interfere with the Equipment unless authorized by staff and must follow all instructions.

• The Client is responsible for any loss, theft, or damage to Equipment caused by guests or anyone present at the event location during the rental period (excluding normal wear and tear).

• The Client agrees to pay the full cost of repair or replacement if required.

Customer Equipment Rentals (No Staff Present)

When Equipment is rented without staff present, the Client assumes full responsibility for safe operation and care of the Equipment during the rental period.

The Client agrees that:

• Equipment will only be operated by a responsible adult (18 years or older).

• The operator must not be under the influence of alcohol, cannabis, or any impairing substances.

• Long hair must be securely tied back while operating the machine.

• Equipment will not be altered, misused, or moved while in operation unless instructed.

• Only foam solution supplied or approved by Foam Party Explosion may be used. Unauthorized substances (including dish soap or homemade mixtures) are strictly prohibited.

• The Client is fully responsible for any loss, theft, or damage to the Equipment during the rental period (excluding normal wear and tear).

• Damage resulting from misuse or unauthorized substances will require full repair or replacement payment.

• Foam Party Explosion reserves the right to refuse or terminate a rental if unsafe operation or misuse is observed.

6. Health Considerations & Foam Disclaimer

• Our foam solution is non-toxic, biodegradable, and generally safe.

• Individuals with allergies, asthma, sensitive skin, or respiratory conditions should consult a physician before participating.

• Foam should be treated similarly to swimming pool water.

• Participants should keep their eyes closed when placing their face directly into the foam, as temporary irritation may occur.

• Participants should avoid rubbing their eyes while in the foam area.

• Foam should not be intentionally inhaled or ingested.

• Breathing in foam may cause coughing or throat irritation.

• While non-toxic, the foam is not intended for consumption.

• Participants are encouraged to rinse off or shower after the event, as they would after swimming.

• Foam Party Explosion is not responsible for allergic reactions, irritation, or other health responses related to participation.

7. Liability Waiver & Assumption of Risk

By booking or participating, the client and all participants:

• Voluntarily assume all risks associated with foam party activities.

• Release and hold harmless Foam Party Explosion, its owners, employees, and contractors from any claims, injuries, damages, or losses.

• Agree that Foam Party Explosion is not liable for personal injury, property damage, or loss arising from participation.

This includes, but is not limited to:

• Slips

• Falls

• Allergic reactions

• Equipment-related incidents

8. Supervision of Minors

• The client is solely responsible for supervising children and ensuring appropriate behavior.

• Foam Party Explosion does not provide childcare or supervision services.

• A responsible adult must be present at all times.

9. Damage to Property

Foam Party Explosion is not responsible for:

• Damage to lawns, grass, landscaping, driveways, decks, or indoor flooring.

• Water exposure or moisture-related damage.

• Slippery residue after the event.

• The client accepts full responsibility for hosting the event on their property.

10. Photography & Media Use

• Foam Party Explosion may take photos or short video clips during events for promotional purposes, including use on our website and social media.

• We respect our clients’ privacy.

• If you prefer that photos or videos not be taken or shared from your event, please let us know prior to the event date, and we will gladly honor your request.

11. Force Majeure

Foam Party Explosion is not responsible for delays or cancellations caused by circumstances beyond our control, including but not limited to:

• Severe weather

• Power outages

• Government restrictions

• Emergencies or acts of God

12. Governing Law

• These Terms & Conditions are governed by the laws of the Province of Manitoba, Canada.

13. Agreement Acknowledgement

• By booking services with Foam Party Explosion, the client acknowledges they have read, understood, and agreed to these Terms & Conditions.
